1. Scope and acceptance

These Terms of Use apply to the AIPower Pay website, public resources and online enquiry functions operated by FBA INTERNATIONAL FINANCE LIMITED (“AIPower Pay”, “we”, “us” or “our”). By accessing or using the website, you agree to these terms. If you do not agree, do not use the website.

The website is intended for business users and people acting for an organisation. It is not a consumer bank account, stored-value facility or personal financial-advice service.

2. Website information

Website content is provided for general business information. Product descriptions, market coverage, payment methods, settlement examples and performance ranges are illustrative and may depend on merchant profile, location, technical configuration, provider availability and approval.

Nothing on the website is an offer, approval, guarantee of acceptance or promise of a particular authorisation rate, cost saving, settlement date or regulatory outcome. We may correct, update, withdraw or replace content without prior notice.

3. Merchant services require a separate agreement

Submitting an enquiry, viewing technical material or using the website does not create a merchant account or oblige either party to provide services. Payment processing begins only after required review, approval, contracting, configuration and activation.

If you enter into a signed merchant agreement, service schedule or country addendum, that document governs the relevant service and prevails over these website terms if there is a conflict.

4. Acceptable use

You must not misuse the website, interfere with its security or availability, attempt unauthorised access, introduce malicious code, scrape it in a manner that causes disruption, impersonate another person, submit misleading information or use the website for unlawful activity.

Use of payment services is also subject to our Acceptable Use Policy and the restrictions in the applicable merchant agreement.

5. Intellectual property

Unless otherwise stated, the website, its original text, layout, graphics, AIPower Pay branding and software are owned by or licensed to us. We grant you a limited, revocable, non-exclusive right to view and use the website for legitimate internal business purposes.

Third-party names, payment marks and logos belong to their respective owners. Their appearance does not imply that every product is available to every merchant or in every country.

6. Third-party services and links

The website may link to merchant portals, payment networks, identity-verification providers, documentation or other third-party services. Those services are governed by their own terms and privacy notices. We are not responsible for third-party content, availability or decisions, including issuer authentication and authorisation outcomes.

7. Availability and disclaimers

We take reasonable care with the website, but do not promise that it will always be available, error-free, complete or suitable for a particular purpose. To the maximum extent permitted by law, the website is provided on an “as available” basis and implied warranties are excluded.

Nothing in these terms excludes a right or liability that cannot lawfully be excluded. You remain responsible for obtaining professional legal, tax, compliance and technical advice for your business.

8. Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential loss arising only from use of, or reliance on, the public website. Any liability relating to paid merchant services is governed by the applicable signed agreement.

This limitation does not apply where liability cannot be limited under applicable law, or to fraud or fraudulent misrepresentation.

9. Governing law and jurisdiction

These website terms are governed by the laws of Hong Kong. The courts of Hong Kong have non-exclusive jurisdiction. This means proceedings may also be brought before another court that is lawfully competent, including where mandatory law in a user’s or merchant’s location applies.

A separate merchant agreement may contain a different governing-law or dispute-resolution clause, in which case that clause governs the contracted service.

10. Changes and contact

We may update these terms to reflect changes in the website, our services or applicable requirements. The revised date appears at the top of this page. Continued use after an update means the revised terms apply from the stated date.
